This week’s #fridayfacts is dedicated to Fortune Telling. In NY, it is a Class B Misdemeanor to commit the offense of Fortune Telling, which the State views as a variety of theft.
A person is guilty of Fortune Telling if they:
- Claim or pretend to tell fortunes, or exorcise, influence or affect evil spirits or curses; and
- The person solicited or received money for such conduct; and
- The person didn’t do it purely for entertainment or amusement.
A conviction for Fortune Telling can result in up to 3 months in jail or 1 year of probation, plus a victim assistance fee to the State.
