- Larceny is stealing someone else’s property.
- Mischief is destroying someone else’s property.
In NY:
- Stealing property worth up to $1,000 = Petit Larceny, Class A Misdemeanor (up to 1 year in jail).
- Destroying property worth more than $250 = Criminal Mischief in the 3rd Degree, Class E Felony (up to 4 years in state prison).
So, steal an iPhone — jail for a year. Smash it — prison for four.
