If you are convicted of any felony, or a misdemeanor under the NY Penal Law, Executive Law § 995 requires you to submit a DNA sample to the NY DNA Databank for use in investigative indexing.
If you are convicted of a misdemeanor DWI, you are not required to submit a DNA sample.
